In order to stay safe and protect other drivers on the roadways, the best choice is always to arrange for transportation by a sober driver if you drink alcohol or utilize have a designated driver should you choose to consume alcohol or drugs. However, if you find yourself being investigated for impairment during a stop, or the subject of a DUI arrest, please follow these recommendations in order to protect your rights:

1) NEVER ADMIT TO CONSUMING ALCOHOL OR DRUGS. 

Simply do not answer the question, and provide your license and registration if you can.

2) NEVER PERFORM FIELD TESTS. 

In other words, don’t count backwards, don’t say your ABCs, don’t follow the pen with your eyes, don’t walk the imaginary line and do the fancy turn, don’t lift your leg for twenty seconds, and don’t blow into the PBT.

You don’t have to be rude about it, but when the officer tells you, “I want you to step out of the car and do some field tests for me,” you can just say,

“ No, thank you. I decline to perform all testing.”

3) NEVER CONSENT TO A BLOOD DRAW.

The officers can draft a search warrant, if they like. It may take longer, but that’s ok.

4) WHILE AT THE STATION, YOU SHOULD SUBMIT TO THE INTOXYLIZER.

If you refuse the intoxylizer, which is the device to measure breath alcohol concentration that is at a police station or Troop, you may automatically lose your license because you consent to comply when you receive a Delaware license.

5) DO NOT WAIVE MIRANDA. 

When you hear, “you have the right to remain silent….” Quickly and clearly respond that you wish to remain silent and want a lawyer.

6) DON’T ENGAGE IN CASUAL CONVERSATION WITH THE OFFICER. 

You all are not friends; this is business.
