Discrimination

Discrimination in employment is against the law. There are Federal and State laws that prohibit discrimination by employers against members of a protected class including race, sex, disability, color, national origin, and others. If you believe that you have been discriminated against because of your membership in a protected class, you should first follow the procedures in your Employer’s handbook related to reporting discrimination. Your report should be in writing, and you should keep a copy.

If the discrimination is not eradicated, you should visit the Delaware Department of Labor’s Department of Anti-Discrimination’s website to learn about the process of filing a State and Federal charge, which ultimately will allow you to obtain a Right to Sue within the State in the Delaware Superior Court and/or on the federal level in the United States District Court of Delaware. Tasha M. Stevens-Gueh, Esquire has successfully litigated employment discrimination cases in Federal and State courts and has successfully obtained damages for her clients. Worker’s Compensation Retaliation

Employers are not allowed to punish an employee for being hurt on the job or for pursuing Worker’s Compensation benefits. So, if you were hurt on the job and fired, disciplined, or demoted shortly after suffering a work-related injury or after applying or worker’s compensation benefits, or otherwise mistreated in terms of the benefits and privileges of your job, you may have an action for Retaliation. Contact ASG Law for a consultation to review the facts of your case.
